New Delhi: In a significant legal victory for the Tata Group, the Delhi High Court has issued a permanent injunction against the Managing Director of Taj Iconic Membership, prohibiting their use of the iconic ‘Taj’ brand. The court’s decision came in response to a trademark infringement suit filed by Indian Hotels Company (IHCL), the hospitality arm of the Tata Group.
The lawsuit accused Taj Iconic Membership of impersonating IHCL and defrauding a jeweller of 100 gold coins, valued at Rs 51 lakh. The court found that Taj Iconic Membership’s use of the ‘Taj’ name was misleading and likely to cause confusion among consumers.
As a result of the court’s ruling, the Managing Director of Taj Iconic Membership has been ordered to pay a penalty of Rs 10 lakh in damages and Rs 5 lakh in costs. Additionally, the domain name associated with Taj Iconic Membership will be transferred to IHCL.

This is not the first time that the ‘Taj’ trademark has been protected by the courts. Earlier this year, IHCL successfully defended its trademark rights in a similar case against Shivgyan Developers. The court’s decision in both cases underscores the importance of protecting iconic brands from unauthorized use.
The Delhi High Court’s ruling is a significant victory for IHCL and serves as a warning to others who may attempt to capitalize on the reputation of well-known brands.
